Due to the restrictions and qualifications for obtaining a trademark registration imposed upon by the Trademarks Act as well as general common law considerations, trademarks which are inherently strong tend to exhibit the following characteristics:
1. They are short, usually two words or less;
2. They are not descriptive and/or deceptively miss-descriptive.
3. They are normally coined words such as DOFASCO, GOOGLE, COKE, JEEP and ZEROX.
The owner of an inherently strong mark enjoys the ability to easily prevent others from using marks that are remotely similar to the trademark that he owns and are easily defended should a trademark infringement arise.
